Overview
These Terms of Service ("Terms") govern your use of The Scene mobile application and related services ("the Service"). By creating an account, you agree to these Terms.
The Scene is operated by an Australian entity ("we", "us", "our"). If you do not agree with these Terms, do not use the Service.
1. Eligibility
1.1 Age Requirement
You must be at least 18 years old to use The Scene. By creating an account, you confirm that you are 18 or older. We reserve the right to verify your age and to terminate accounts that violate this requirement.
1.2 Legal Capacity
You must have the legal capacity to enter into a binding agreement. You must not be prohibited from using the Service under applicable law.
1.3 One Account Per Person
You may only maintain one active account. Creating multiple accounts to circumvent bans, manipulate the platform, or deceive other users is prohibited.
2. Your Account
2.1 Account Creation
- You must provide accurate information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
2.2 Account Security
- Notify us immediately if you suspect unauthorised access to your account.
- We are not liable for losses caused by unauthorised use of your account.
- Use a strong, unique password. We recommend enabling any additional security features we offer.
2.3 Profile Accuracy
- Your profile information must be truthful. Misrepresenting your identity, age, or intentions is grounds for immediate termination.
- You may use a pseudonym or display name rather than your legal name.
3. Consent Culture and Community Standards
The Scene is built on a foundation of consent. This is non-negotiable.
3.1 Consent Expectations
- Consent is mandatory for all interactions, both online and at any events connected to the platform.
- Respect stated boundaries. When someone communicates a limit, you respect it. No exceptions.
- No means no. Silence or non-response also means no. Enthusiastic, clear, ongoing consent is the standard.
- Consent can be withdrawn at any time. Previously given consent does not imply ongoing consent.
3.2 Community Behaviour
- Treat every member with respect and dignity.
- Do not pressure, coerce, or manipulate other users.
- Do not share private conversations or interactions outside the platform without explicit consent from all parties involved.
- Do not reveal another person's identity, preferences, or participation on the platform to anyone outside the platform ("outing").
4. Prohibited Content and Conduct
The following are strictly prohibited and will result in immediate action, up to and including permanent ban and referral to law enforcement:
4.1 Absolutely Prohibited
- Any content involving minors in any sexual context. This will be reported to authorities.
- Non-consensual content of any kind, including non-consensual sharing of intimate images.
- Content depicting or promoting illegal activity.
- Threats of violence, harassment, stalking, or intimidation.
- Hate speech targeting race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Fraud, scams, or deceptive practices.
- Impersonation of another person.
- Commercial solicitation, spam, or advertising without authorisation.
4.2 Content Standards
- Profile photos must not contain nudity. This is required for App Store and Play Store compliance. Profiles with nude photos will have the photos removed.
- Photos must not include identifiable images of other people without their consent.
- Content must not include personal contact information (phone numbers, addresses, external social media handles) in profile bios. Use the in-app messaging system.
- All content must comply with applicable laws in your jurisdiction.
4.3 Reporting Obligations
- If you become aware of any content involving minors, you must report it to us immediately.
- If you witness behaviour that violates these Terms, we encourage you to report it through the in-app reporting system.
- We will investigate all reports and take appropriate action. We may involve law enforcement where necessary.
5. Photo Guidelines
To comply with Apple App Store and Google Play Store policies, and to maintain community safety:
- No nudity in profile photos. This includes full or partial nudity.
- No sexually explicit images in any publicly visible area of the platform.
- No photos of other people without their explicit consent.
- No photos of minors in any context.
- Photos must be of you (or a non-identifying placeholder you choose).
- We reserve the right to remove photos that violate these guidelines without notice.
6. Certifications and Badges
The Scene offers a certification and badge system to help users demonstrate knowledge and build trust within the community.
6.1 Badge Integrity
- Badges and certifications are earned by completing specific courses and passing quizzes within the app.
- Do not claim certifications you have not earned. Misrepresenting your badges or qualifications is a violation of these Terms.
- Badges reflect completion of educational content within the app. They do not constitute professional credentials, qualifications, or certifications outside of The Scene.
6.2 Badge Display
- Earned badges are displayed on your profile automatically.
- Other users may filter or search based on badges. Accuracy matters.
7. Subscriptions and Payments
7.1 Free Tier
The Scene offers a free tier that includes core features including profile creation, limited discovery, and basic messaging.
7.2 Premium Subscription
- The Scene Premium is available at $14.99 AUD per month (or local currency equivalent).
- Premium features include advanced discovery filters, expanded quiz access, unlimited messaging, and other features as described in the app.
- Pricing may change. We will notify you of any price changes before your next billing cycle.
7.3 Billing
- Subscriptions are billed through the Apple App Store or Google Play Store.
- Payment processing is handled entirely by Apple or Google. We do not store your payment information.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
7.4 Cancellation and Refunds
- You can cancel your subscription at any time through your App Store or Play Store account settings.
- Cancellation takes effect at the end of the current billing period. You retain Premium access until then.
- Refund requests are handled by Apple or Google according to their respective refund policies.
7.5 Changes to Premium
- We may add, modify, or remove Premium features. Significant changes will be communicated in advance.
8. Intellectual Property
8.1 Our Content
- The Scene app, its design, features, educational content, quizzes, course material, and branding are owned by us or our licensors.
- You may not copy, reproduce, distribute, or create derivative works from our content without written permission.
8.2 Your Content
- You retain ownership of content you create and upload (photos, bio text, messages).
- By uploading content, you grant us a limited, non-exclusive, worldwide licence to use, display, and distribute that content within the Service for the purpose of operating the platform.
- This licence ends when you delete the content or your account.
8.3 Copyright Complaints
- If you believe your copyrighted work has been used on the platform without authorisation, contact us with details and we will investigate.
9. Limitation of Liability
9.1 The Service Is Provided "As Is"
- We provide The Scene on an "as is" and "as available" basis.
- We do not guarantee uninterrupted, error-free, or secure operation of the Service.
- We do not guarantee the accuracy, completeness, or reliability of any content posted by users.
9.2 No Liability for User Interactions
- We are not responsible for the behaviour, actions, or content of other users.
- Interactions with other users, whether online or in person, are at your own risk.
- We strongly encourage you to exercise caution and follow safety best practices when meeting anyone from the platform in person.
9.3 Limitation
- To the maximum extent permitted by Australian law, our total liability to you for any claims arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.
- We are not liable for indirect, incidental, consequential, special, or punitive damages.
9.4 Australian Consumer Law
- Nothing in these Terms excludes or limits rights you may have under the Australian Consumer Law that cannot be excluded or limited by agreement.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third party's rights.
- Content you upload or share on the platform.
11. Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Australia.
11.2 Informal Resolution First
Before filing any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting us. We will try to resolve the matter within 30 days.
11.3 No Class Actions
To the extent permitted by law, disputes will be resolved on an individual basis. You waive the right to participate in class actions or class-wide arbitration.
12. Termination
12.1 Your Right to Terminate
You may delete your account at any time through the app settings. Account deletion is permanent.
12.2 Our Right to Terminate
We may suspend or terminate your account if:
- You violate these Terms or our Community Guidelines.
- We reasonably believe your account poses a safety risk to other users.
- We receive a valid legal request requiring us to do so.
- Your account has been inactive for more than 12 months.
12.3 Effect of Termination
- Upon termination, your right to use the Service ceases immediately.
- Your data will be deleted in accordance with our Privacy Policy.
- Provisions of these Terms that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will survive.
13. Modifications to These Terms
- We may update these Terms from time to time.
- We will notify you of material changes via in-app notification at least 14 days before changes take effect.
- Continued use after changes take effect constitutes acceptance.
- If you disagree with changes, you may delete your account before they take effect.
14. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and us.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect.
- No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
- Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
